“Pushing people from a dam is not an adequate means of dissolving an assembly.” Supreme Administrative Court 27.2.1987, B 45/85. There must be a reason why association and assembly laws are mentioned in the same breath. But not all associations are so wild. We can offer advice on the creation of an association, assist you in dealing with the authorities as well as with (judicial) interventions due to disputes under association law. We also organise regular seminars on the topic of “association law” and operate our own website on the topic:  . We are a partner of the representation of interests of non-profit organisations (“IGO” ,www.gemeinnuetzig.at) and work closely with non-profit organisations from different fields.

There are foundations formed under the Austrian Private Foundations Act that can (but do not have to) be non-profit, and non-profit foundations formed under the Federal Foundation and Fund Act. We are happy to discuss with you what foundation you need, or whether a (non-profit?) association or a (non-profit?) company would be a better solution.

Non-profit is a concept found in tax law which, when handled right, offers benefits in terms of VAT and corporate taxes. A word of caution: Your association (or foundation or company) can be entirely non-profit-oriented – if its bylaws (deed of foundation, articles of association) are not designed the way finance authorities expect them to be, you risk losing your non-profit status and having to pay back taxes. We can check your organisational requirements, assist you in creating a non-profit organisation and offer continuous advice during operations. We work together with specialised tax lawyers in this field too.
