Personal Rights (name rights, protection of images, discredit law, protections against defamation in civil and criminal law)

Thomas Höhne, Georg Streit

The field of personal rights is a wide one: name rights, right to one's own image, right to one's own biography, right to honour - and these legal assets are protected by the ABGB, copyright law and media law, as well as the criminal code. That's a lot of paragraphs relating to something you can neither see nor touch. Nevertheless, it can be affected and infringed, which can even result in the annihilation of the affected party's existence.

However, the multitude of paragraphs provides us - and you  - with diverse possibilities of defence against infringements. They can, in the hands of a well-practiced lawyer, prevent the worst and, often enough, even nip it in the bud.
